These Terms govern access to the BKMOS website and the submission, quotation, ordering and use of translation and related services provided by BKMOS.

Last updated: 18 August 2026

Sending documents or requesting a quotation does not automatically create an order. BKMOS begins work after the project scope, price and relevant requirements have been confirmed in an agreed quotation, contract, payment confirmation or other recorded communication.

1. Service Provider

The website bkmos.com and BKMOS services are operated by
CÔNG TY TNHH DỊCH THUẬT BKMOS (“BKMOS”, “we”, “us” or “our”).

In these Terms, “you” or “Client” means the individual or organization that accesses the website,
requests a quote, places an order or uses BKMOS services.

2. Scope of These Terms

These Terms apply to:

  • accessing and using information on the BKMOS website;
  • sending documents, enquiries and quotation requests;
  • ordering translation, editing, proofreading, interpreting, localization, certified translation and related services; and
  • transactions confirmed through the website, email, telephone, messaging applications or other accepted electronic channels.

A quotation, order confirmation, service contract, project brief or other document specifically agreed
for a project forms part of the service arrangement. If a project-specific agreement conflicts with
these general Terms, the project-specific agreement will normally prevail for that project,
except where mandatory law requires otherwise.

3. Eligibility and Authority

A person placing an order should be at least 18 years old and have legal capacity appropriate
to the transaction. A person acting for a company, organization or another individual represents
that they have the authority required to submit the request, provide the documents and agree to the service.

Where a minor is involved, use of the service must comply with applicable rules concerning capacity,
consent and legal representation.

4. Permitted Use of the Website

BKMOS grants you a limited, non-exclusive and non-transferable right to use the website for lawful purposes,
such as learning about services, requesting quotations and communicating with BKMOS.

Unless BKMOS gives prior written permission or applicable law allows otherwise, this right does not include
copying, scraping, mass-republishing, reselling, commercially exploiting or distributing website content
or databases.

BKMOS may restrict access where there are reasonable grounds to believe that a user is acting unlawfully,
fraudulently, disruptively, or in a manner that threatens systems, data, BKMOS or third parties.

5. Service Information and Quotations

Information about services, reference prices, expected turnaround and processes published on the website
is provided for general guidance and does not constitute a binding offer for every document or project.

A final quotation may depend on:

  • source and target languages;
  • document type and volume;
  • specialist subject matter and terminology;
  • quality and legibility of source files;
  • formatting, desktop-publishing or file-preparation requirements;
  • deadline and production schedule;
  • certification, notarization, legalization or other requested formal procedures;
  • number of hard copies and delivery method; and
  • other requirements disclosed before confirmation.

A BKMOS quotation may specify the scope, language direction, estimated delivery time, price,
taxes or additional charges, payment method, delivery method, quotation validity period and special conditions.

BKMOS does not unilaterally change the price of an already confirmed order.
If the source documents, volume, deadline or requested scope changes, any corresponding price or schedule
adjustment will be communicated before the additional or changed work proceeds.

6. When an Order Is Formed

Sending documents or requesting a quotation does not by itself mean that BKMOS has accepted an order.
An order is treated as confirmed when one of the following occurs:

  • the Client accepts a quotation and BKMOS confirms the order;
  • the parties sign a service agreement or equivalent document;
  • the Client makes the payment or deposit required by the quotation and BKMOS confirms commencement; or
  • the parties otherwise confirm the order by email, message or another recordable electronic method.

When BKMOS may decline a request

BKMOS may decline or discontinue a request where, for example:

  • the requested activity is unlawful or appears fraudulent;
  • the documents are prohibited, unlawful or appear to infringe third-party rights;
  • the source materials are too incomplete or illegible to perform the service reliably;
  • the required expertise, technology or realistic production time is unavailable;
  • there is a conflict of interest or material legal or security risk; or
  • the parties cannot agree on scope, price or timing.

7. Client Responsibilities

The Client is responsible for:

  • providing accurate contact and project information;
  • providing complete and legible source documents;
  • telling BKMOS the intended use and any known receiving-authority requirements;
  • providing required terminology, reference files, templates or style instructions before work begins;
  • checking and confirming ambiguous names, dates, figures, identifiers and specialist information where clarification is requested;
  • having the lawful right or authority to provide documents and personal data to BKMOS;
  • not submitting falsified documents or requesting fraudulent alteration of content; and
  • making payments and performing agreed obligations on time.

Unless specifically agreed otherwise, BKMOS is not responsible for verifying the authenticity,
legal validity or ownership of source documents. The Client remains responsible for the lawfulness
and authenticity of the material submitted.

8. Timing and Delivery

Production time normally begins when BKMOS has received the complete source material,
necessary instructions, order confirmation and any payment or deposit required by the agreement.

A delivery time stated in a quotation is an expected schedule unless the parties expressly agree
that a particular deadline is binding.

Results may be delivered by email, download link, messaging application, courier, office collection
or another agreed method.

Where a project depends on a notary office, competent authority, diplomatic authority, courier
or other independent third party, completion may also depend on that party’s schedule and procedures.
BKMOS will communicate a known or reasonably foreseeable delay when appropriate.

9. Review, Corrections and Translation Errors

Clients should review delivered work promptly, paying particular attention to names, passport numbers,
dates, addresses, figures, case numbers and other identifying information.

Within 30 days after delivery, the Client may ask BKMOS to review and correct without
additional translation fees:

  • a mistranslation or omission compared with the source material;
  • a typing or formatting error within the confirmed scope; or
  • content that does not follow a glossary or instruction supplied before the work was performed.

Free correction does not normally apply to:

  • changes made to the source material after work began;
  • new content or requirements outside the original scope;
  • stylistic preferences that are not translation errors;
  • new requirements introduced by a receiving organization after completion and not disclosed beforehand; or
  • incorrect or incomplete information contained in the Client’s source files.

The 30-day review arrangement does not remove any statutory consumer or other rights that cannot lawfully be excluded.

10. Changes, Cancellation and Refunds

The Client may request a change or cancellation through the contact channel used for the order.
Refunds and charges are handled according to the work actually completed and non-recoverable costs.

  • If cancellation occurs before work begins, amounts received may be refunded, less any non-recoverable third-party costs previously disclosed and accepted.
  • If work has started, the Client is responsible for the portion completed and reasonable costs already incurred.
  • The balance corresponding to unperformed work will be refunded where applicable.
  • If BKMOS cannot complete the service due to a cause attributable to BKMOS, the unused portion of the service fee will be refunded as appropriate.
  • Where the service has been completed within the confirmed scope, a refund may not be available merely because the Client no longer needs the translation.

Any material deduction or non-recoverable cost will be explained before the refund is processed.

11. Certified Translation, Notarization and Third-Party Procedures

Certain services may require involvement from translators or collaborators, notary offices,
judicial or administrative bodies, diplomatic authorities, couriers or other service providers.

BKMOS will make reasonable efforts to coordinate suitable providers where those services form part
of the agreed scope. However, decisions to notarize, certify, legalize, issue a visa,
accept an application or recognize a document remain with the relevant authority or receiving organization.

BKMOS cannot guarantee acceptance where, for example:

  • the receiving organization’s requirements were not provided in advance;
  • the authority changes its procedure, form or policy;
  • the source document is invalid, incomplete or inaccurate; or
  • rejection occurs for a reason unrelated to the translation quality.

This does not remove BKMOS’s responsibility for a translation or service error that is attributable to BKMOS.

12. Payment, Taxes and Invoices

Payment must be made in the amount, method and time stated in the quotation,
service agreement or order confirmation. BKMOS may require full payment or a deposit before work begins,
depending on project value, complexity and deadline.

Clients should verify payment instructions supplied by BKMOS before transferring funds.
Invoices and supporting documents are issued according to the agreement and applicable tax,
accounting and invoicing requirements.

13. Confidentiality and Personal Data

BKMOS recognizes that translation projects may include private, confidential, commercial,
legal, medical, financial or other sensitive information.

Documents may be accessed or shared only to the extent reasonably necessary for the service,
including with relevant employees, translators, editors, specialist collaborators,
notary offices, authorities, couriers, technology providers or other agreed service providers.

Personal data is handled in accordance with the
BKMOS Privacy Policy
and applicable law. Project-specific confidentiality or NDA arrangements may also apply where agreed.

14. Service Communications and Marketing

BKMOS may use the contact details provided to:

  • respond to enquiries and quotations;
  • confirm orders;
  • request clarification or missing documents;
  • provide progress, delivery, payment or invoice information;
  • resolve complaints; and
  • provide post-service support.

Marketing or promotional communications will be sent only where consent or another lawful basis applies.
Opting out of marketing does not stop necessary messages relating to an active order or transaction.

15. Intellectual Property

Unless stated otherwise, website content such as BKMOS’s trade name, logo, design,
layout, text, images, graphics, guides, databases and original materials is owned by BKMOS
or used under a lawful right or license.

You may not copy, modify, republish, distribute, sell, rent, scrape or commercially exploit
such content without prior permission except where permitted by law.

Ownership of source documents remains with the Client or the lawful rights holder.
After the Client has completed the agreed payment obligations, the Client may use the translation
for the purpose and scope agreed for the project.

BKMOS will not publicly use a Client’s confidential documents or translation deliverables
as marketing materials or portfolio samples without the Client’s permission.

BKMOS’s general working methods, internal processes, templates, tools, non-client-specific language resources
and professional know-how remain under BKMOS’s control to the extent they do not contain Client confidential information.

16. Prohibited Use

When using the website or services, you must not:

  • use BKMOS for an unlawful or fraudulent purpose;
  • impersonate another person or misrepresent your authority;
  • submit fraudulent documents or request deceptive alteration of content;
  • upload malware, viruses or harmful code;
  • attempt unauthorized access to systems, servers, accounts or data;
  • interfere with normal website operation or security;
  • conduct unauthorized automated harvesting, scraping or database extraction;
  • infringe intellectual-property, privacy or other lawful rights; or
  • use BKMOS content or branding to impersonate BKMOS or offer services falsely under the BKMOS name.

17. Responsibility and Limitation of Liability

BKMOS will provide services with reasonable care within the confirmed scope,
standards and project requirements.

Where loss is caused by an error attributable to BKMOS, responsibility will be determined by reference to:

  • the respective fault of the parties;
  • actual and directly provable loss;
  • the relevant quotation, contract or project agreement; and
  • applicable law.

To the extent permitted by law, BKMOS is not responsible for loss caused by:

  • incorrect, incomplete, illegible, ambiguous or falsified source material;
  • incorrect instructions or information supplied by the Client;
  • unauthorized changes made to a translation after delivery;
  • use of a translation outside the purpose or scope disclosed to BKMOS;
  • an independent decision of a government authority, embassy, educational institution, bank or receiving organization;
  • failures of telecommunications networks, payment systems, couriers or other independent third parties outside BKMOS’s reasonable control; or
  • a force-majeure event.
Nothing in these Terms excludes or limits consumer rights, liability or remedies
that cannot lawfully be excluded or limited.

18. Force Majeure

A party will not be treated as failing to perform an obligation to the extent performance is prevented
by an event beyond reasonable control that qualifies as force majeure under applicable law or the relevant agreement.

Examples may include natural disasters, fire, epidemic, war, civil unrest,
major infrastructure failure, prolonged power outage, serious cyberattack,
government action or another objective event that could not reasonably be prevented or overcome.

The affected party should provide reasonable notice, take reasonable steps to mitigate loss,
and resume performance when conditions permit.

19. Changes to These Terms

BKMOS may update these Terms to reflect changes in services, business operations,
website functionality or applicable law. The updated version will be published on this page
and the “Last updated” date will be revised.

Unless mandatory law requires otherwise, changes normally apply to website use and transactions
arising after the updated version takes effect. A previously confirmed project remains governed
by the terms agreed for that project unless the parties agree otherwise or law requires a change.

20. Complaints and Service Concerns

If you have a complaint or service concern, please provide enough information for BKMOS to identify
and review the matter, such as:

  • your name and contact details;
  • order or transaction reference;
  • a description of the issue;
  • relevant files, images or supporting evidence; and
  • the outcome you are requesting.

BKMOS will review the request based on the project record, the parties’ communications,
supporting evidence and applicable law.

21. Governing Law and Dispute Resolution

These Terms and BKMOS service transactions are governed by the laws of Vietnam,
except where mandatory law provides otherwise.

The parties should first attempt to resolve a dispute through direct discussion or other cooperative means.
If a dispute cannot be resolved, either party may use a competent state authority,
dispute-resolution body or court in accordance with applicable law.

These Terms do not restrict any complaint, consumer-protection, legal-action or other right
that cannot lawfully be waived.

22. Severability

If any part of these Terms is held invalid, unlawful or unenforceable,
the remaining provisions will continue to apply to the extent permitted by law.
The invalid provision may be interpreted or replaced by a lawful provision that most closely reflects
its legitimate purpose while preserving the parties’ lawful rights and interests.
