BKMOS begins work after the project scope, price and relevant requirements have been confirmed in an agreed quotation, contract, payment confirmation or other recorded communication.<\/div>\n<h2 id=\"provider\">1. Scope of These Terms<\/h2>\n<p>These Terms apply to:<\/p>\n<ul>\n<li>accessing and using information on the BKMOS website;<\/li>\n<li>sending documents, enquiries and quotation requests;<\/li>\n<li>ordering translation, editing, proofreading, interpreting, localization, certified translation and related services; and<\/li>\n<li>transactions confirmed through the website, email, telephone, messaging applications or other accepted electronic channels.<\/li>\n<\/ul>\n<p>A quotation, order confirmation, service contract, project brief or other document specifically agreed<br \/>\nfor a project forms part of the service arrangement. If a project-specific agreement conflicts with<br \/>\nthese general Terms, the project-specific agreement will normally prevail for that project,<br \/>\nexcept where mandatory law requires otherwise.<\/p>\n<h2 id=\"eligibility\">3. Eligibility and Authority<\/h2>\n<p>A person placing an order should be at least 18 years old and have legal capacity appropriate<br \/>\nto the transaction. A person acting for a company, organization or another individual represents<br \/>\nthat they have the authority required to submit the request, provide the documents and agree to the service.<\/p>\n<p>Where a minor is involved, use of the service must comply with applicable rules concerning capacity,<br \/>\nconsent and legal representation.<\/p>\n<h2 id=\"website-use\">4. Permitted Use of the Website<\/h2>\n<p>BKMOS grants you a limited, non-exclusive and non-transferable right to use the website for lawful purposes,<br \/>\nsuch as learning about services, requesting quotations and communicating with BKMOS.<\/p>\n<p>Unless BKMOS gives prior written permission or applicable law allows otherwise, this right does not include<br \/>\ncopying, scraping, mass-republishing, reselling, commercially exploiting or distributing website content<br \/>\nor databases.<\/p>\n<p>BKMOS may restrict access where there are reasonable grounds to believe that a user is acting unlawfully,<br \/>\nfraudulently, disruptively, or in a manner that threatens systems, data, BKMOS or third parties.<\/p>\n<h2 id=\"quotes\">5. Service Information and Quotations<\/h2>\n<p>Information about services, reference prices, expected turnaround and processes published on the website<br \/>\nis provided for general guidance and does not constitute a binding offer for every document or project.<\/p>\n<p>A final quotation may depend on:<\/p>\n<ul>\n<li>source and target languages;<\/li>\n<li>document type and volume;<\/li>\n<li>specialist subject matter and terminology;<\/li>\n<li>quality and legibility of source files;<\/li>\n<li>formatting, desktop-publishing or file-preparation requirements;<\/li>\n<li>deadline and production schedule;<\/li>\n<li>certification, notarization, legalization or other requested formal procedures;<\/li>\n<li>number of hard copies and delivery method; and<\/li>\n<li>other requirements disclosed before confirmation.<\/li>\n<\/ul>\n<p>A BKMOS quotation may specify the scope, language direction, estimated delivery time, price,<br \/>\ntaxes or additional charges, payment method, delivery method, quotation validity period and special conditions.<\/p>\n<p>BKMOS does not unilaterally change the price of an already confirmed order.<br \/>\nIf the source documents, volume, deadline or requested scope changes, any corresponding price or schedule<br \/>\nadjustment will be communicated before the additional or changed work proceeds.<\/p>\n<h2 id=\"order\">6. When an Order Is Formed<\/h2>\n<p>Sending documents or requesting a quotation does not by itself mean that BKMOS has accepted an order.<br \/>\nAn order is treated as confirmed when one of the following occurs:<\/p>\n<ul>\n<li>the Client accepts a quotation and BKMOS confirms the order;<\/li>\n<li>the parties sign a service agreement or equivalent document;<\/li>\n<li>the Client makes the payment or deposit required by the quotation and BKMOS confirms commencement; or<\/li>\n<li>the parties otherwise confirm the order by email, message or another recordable electronic method.<\/li>\n<\/ul>\n<h3>When BKMOS may decline a request<\/h3>\n<p>BKMOS may decline or discontinue a request where, for example:<\/p>\n<ul>\n<li>the requested activity is unlawful or appears fraudulent;<\/li>\n<li>the documents are prohibited, unlawful or appear to infringe third-party rights;<\/li>\n<li>the source materials are too incomplete or illegible to perform the service reliably;<\/li>\n<li>the required expertise, technology or realistic production time is unavailable;<\/li>\n<li>there is a conflict of interest or material legal or security risk; or<\/li>\n<li>the parties cannot agree on scope, price or timing.<\/li>\n<\/ul>\n<h2 id=\"client\">7. Client Responsibilities<\/h2>\n<p>The Client is responsible for:<\/p>\n<ul>\n<li>providing accurate contact and project information;<\/li>\n<li>providing complete and legible source documents;<\/li>\n<li>telling BKMOS the intended use and any known receiving-authority requirements;<\/li>\n<li>providing required terminology, reference files, templates or style instructions before work begins;<\/li>\n<li>checking and confirming ambiguous names, dates, figures, identifiers and specialist information where clarification is requested;<\/li>\n<li>having the lawful right or authority to provide documents and personal data to BKMOS;<\/li>\n<li>not submitting falsified documents or requesting fraudulent alteration of content; and<\/li>\n<li>making payments and performing agreed obligations on time.<\/li>\n<\/ul>\n<p>Unless specifically agreed otherwise, BKMOS is not responsible for verifying the authenticity,<br \/>\nlegal validity or ownership of source documents. The Client remains responsible for the lawfulness<br \/>\nand authenticity of the material submitted.<\/p>\n<h2 id=\"delivery\">8. Timing and Delivery<\/h2>\n<p>Production time normally begins when BKMOS has received the complete source material,<br \/>\nnecessary instructions, order confirmation and any payment or deposit required by the agreement.<\/p>\n<p>A delivery time stated in a quotation is an expected schedule unless the parties expressly agree<br \/>\nthat a particular deadline is binding.<\/p>\n<p>Results may be delivered by email, download link, messaging application, courier, office collection<br \/>\nor another agreed method.<\/p>\n<p>Where a project depends on a notary office, competent authority, diplomatic authority, courier<br \/>\nor other independent third party, completion may also depend on that party&#8217;s schedule and procedures.<br \/>\nBKMOS will communicate a known or reasonably foreseeable delay when appropriate.<\/p>\n<h2 id=\"revisions\">9. Review, Corrections and Translation Errors<\/h2>\n<p>Clients should review delivered work promptly, paying particular attention to names, passport numbers,<br \/>\ndates, addresses, figures, case numbers and other identifying information.<\/p>\n<p>Within <strong>30 days after delivery<\/strong>, the Client may ask BKMOS to review and correct without<br \/>\nadditional translation fees:<\/p>\n<ul>\n<li>a mistranslation or omission compared with the source material;<\/li>\n<li>a typing or formatting error within the confirmed scope; or<\/li>\n<li>content that does not follow a glossary or instruction supplied before the work was performed.<\/li>\n<\/ul>\n<p>Free correction does not normally apply to:<\/p>\n<ul>\n<li>changes made to the source material after work began;<\/li>\n<li>new content or requirements outside the original scope;<\/li>\n<li>stylistic preferences that are not translation errors;<\/li>\n<li>new requirements introduced by a receiving organization after completion and not disclosed beforehand; or<\/li>\n<li>incorrect or incomplete information contained in the Client&#8217;s source files.<\/li>\n<\/ul>\n<p>The 30-day review arrangement does not remove any statutory consumer or other rights that cannot lawfully be excluded.<\/p>\n<h2 id=\"changes-cancellation\">10. Changes, Cancellation and Refunds<\/h2>\n<p>The Client may request a change or cancellation through the contact channel used for the order.<br \/>\nRefunds and charges are handled according to the work actually completed and non-recoverable costs.<\/p>\n<ul>\n<li>If cancellation occurs before work begins, amounts received may be refunded, less any non-recoverable third-party costs previously disclosed and accepted.<\/li>\n<li>If work has started, the Client is responsible for the portion completed and reasonable costs already incurred.<\/li>\n<li>The balance corresponding to unperformed work will be refunded where applicable.<\/li>\n<li>If BKMOS cannot complete the service due to a cause attributable to BKMOS, the unused portion of the service fee will be refunded as appropriate.<\/li>\n<li>Where the service has been completed within the confirmed scope, a refund may not be available merely because the Client no longer needs the translation.<\/li>\n<\/ul>\n<p>Any material deduction or non-recoverable cost will be explained before the refund is processed.<\/p>\n<h2 id=\"third-party-services\">11. Certified Translation, Notarization and Third-Party Procedures<\/h2>\n<p>Certain services may require involvement from translators or collaborators, notary offices,<br \/>\njudicial or administrative bodies, diplomatic authorities, couriers or other service providers.<\/p>\n<p>BKMOS will make reasonable efforts to coordinate suitable providers where those services form part<br \/>\nof the agreed scope. However, decisions to notarize, certify, legalize, issue a visa,<br \/>\naccept an application or recognize a document remain with the relevant authority or receiving organization.<\/p>\n<p>BKMOS cannot guarantee acceptance where, for example:<\/p>\n<ul>\n<li>the receiving organization&#8217;s requirements were not provided in advance;<\/li>\n<li>the authority changes its procedure, form or policy;<\/li>\n<li>the source document is invalid, incomplete or inaccurate; or<\/li>\n<li>rejection occurs for a reason unrelated to the translation quality.<\/li>\n<\/ul>\n<p>This does not remove BKMOS&#8217;s responsibility for a translation or service error that is attributable to BKMOS.<\/p>\n<h2 id=\"payment\">12. Payment, Taxes and Invoices<\/h2>\n<p>Payment must be made in the amount, method and time stated in the quotation,<br \/>\nservice agreement or order confirmation. BKMOS may require full payment or a deposit before work begins,<br \/>\ndepending on project value, complexity and deadline.<\/p>\n<p>Clients should verify payment instructions supplied by BKMOS before transferring funds.<br \/>\nInvoices and supporting documents are issued according to the agreement and applicable tax,<br \/>\naccounting and invoicing requirements.<\/p>\n<h2 id=\"confidentiality\">13. Confidentiality and Personal Data<\/h2>\n<p>BKMOS recognizes that translation projects may include private, confidential, commercial,<br \/>\nlegal, medical, financial or other sensitive information.<\/p>\n<p>Documents may be accessed or shared only to the extent reasonably necessary for the service,<br \/>\nincluding with relevant employees, translators, editors, specialist collaborators,<br \/>\nnotary offices, authorities, couriers, technology providers or other agreed service providers.<\/p>\n<p>Personal data is handled in accordance with the<br \/>\n<a href=\"https:\/\/bkmos.com\/en\/privacy-policy\/\"><strong>BKMOS Privacy Policy<\/strong><\/a><br \/>\nand applicable law. Project-specific confidentiality or NDA arrangements may also apply where agreed.<\/p>\n<h2 id=\"communications\">14. Service Communications and Marketing<\/h2>\n<p>BKMOS may use the contact details provided to:<\/p>\n<ul>\n<li>respond to enquiries and quotations;<\/li>\n<li>confirm orders;<\/li>\n<li>request clarification or missing documents;<\/li>\n<li>provide progress, delivery, payment or invoice information;<\/li>\n<li>resolve complaints; and<\/li>\n<li>provide post-service support.<\/li>\n<\/ul>\n<p>Marketing or promotional communications will be sent only where consent or another lawful basis applies.<br \/>\nOpting out of marketing does not stop necessary messages relating to an active order or transaction.<\/p>\n<h2 id=\"ip\">15. Intellectual Property<\/h2>\n<p>Unless stated otherwise, website content such as BKMOS&#8217;s trade name, logo, design,<br \/>\nlayout, text, images, graphics, guides, databases and original materials is owned by BKMOS<br \/>\nor used under a lawful right or license.<\/p>\n<p>You may not copy, modify, republish, distribute, sell, rent, scrape or commercially exploit<br \/>\nsuch content without prior permission except where permitted by law.<\/p>\n<p>Ownership of source documents remains with the Client or the lawful rights holder.<br \/>\nAfter the Client has completed the agreed payment obligations, the Client may use the translation<br \/>\nfor the purpose and scope agreed for the project.<\/p>\n<p>BKMOS will not publicly use a Client&#8217;s confidential documents or translation deliverables<br \/>\nas marketing materials or portfolio samples without the Client&#8217;s permission.<\/p>\n<p>BKMOS&#8217;s general working methods, internal processes, templates, tools, non-client-specific language resources<br \/>\nand professional know-how remain under BKMOS&#8217;s control to the extent they do not contain Client confidential information.<\/p>\n<h2 id=\"prohibited\">16. Prohibited Use<\/h2>\n<p>When using the website or services, you must not:<\/p>\n<ul>\n<li>use BKMOS for an unlawful or fraudulent purpose;<\/li>\n<li>impersonate another person or misrepresent your authority;<\/li>\n<li>submit fraudulent documents or request deceptive alteration of content;<\/li>\n<li>upload malware, viruses or harmful code;<\/li>\n<li>attempt unauthorized access to systems, servers, accounts or data;<\/li>\n<li>interfere with normal website operation or security;<\/li>\n<li>conduct unauthorized automated harvesting, scraping or database extraction;<\/li>\n<li>infringe intellectual-property, privacy or other lawful rights; or<\/li>\n<li>use BKMOS content or branding to impersonate BKMOS or offer services falsely under the BKMOS name.<\/li>\n<\/ul>\n<h2 id=\"liability\">17. Responsibility and Limitation of Liability<\/h2>\n<p>BKMOS will provide services with reasonable care within the confirmed scope,<br \/>\nstandards and project requirements.<\/p>\n<p>Where loss is caused by an error attributable to BKMOS, responsibility will be determined by reference to:<\/p>\n<ul>\n<li>the respective fault of the parties;<\/li>\n<li>actual and directly provable loss;<\/li>\n<li>the relevant quotation, contract or project agreement; and<\/li>\n<li>applicable law.<\/li>\n<\/ul>\n<p>To the extent permitted by law, BKMOS is not responsible for loss caused by:<\/p>\n<ul>\n<li>incorrect, incomplete, illegible, ambiguous or falsified source material;<\/li>\n<li>incorrect instructions or information supplied by the Client;<\/li>\n<li>unauthorized changes made to a translation after delivery;<\/li>\n<li>use of a translation outside the purpose or scope disclosed to BKMOS;<\/li>\n<li>an independent decision of a government authority, embassy, educational institution, bank or receiving organization;<\/li>\n<li>failures of telecommunications networks, payment systems, couriers or other independent third parties outside BKMOS&#8217;s reasonable control; or<\/li>\n<li>a force-majeure event.<\/li>\n<\/ul>\n<div class=\"notice\">Nothing in these Terms excludes or limits consumer rights, liability or remedies<br \/>\nthat cannot lawfully be excluded or limited.<\/div>\n<h2 id=\"force-majeure\">18. Force Majeure<\/h2>\n<p>A party will not be treated as failing to perform an obligation to the extent performance is prevented<br \/>\nby an event beyond reasonable control that qualifies as force majeure under applicable law or the relevant agreement.<\/p>\n<p>Examples may include natural disasters, fire, epidemic, war, civil unrest,<br \/>\nmajor infrastructure failure, prolonged power outage, serious cyberattack,<br \/>\ngovernment action or another objective event that could not reasonably be prevented or overcome.<\/p>\n<p>The affected party should provide reasonable notice, take reasonable steps to mitigate loss,<br \/>\nand resume performance when conditions permit.<\/p>\n<h2 id=\"changes\">19. Changes to These Terms<\/h2>\n<p>BKMOS may update these Terms to reflect changes in services, business operations,<br \/>\nwebsite functionality or applicable law. The updated version will be published on this page<br \/>\nand the \u201cLast updated\u201d date will be revised.<\/p>\n<p>Unless mandatory law requires otherwise, changes normally apply to website use and transactions<br \/>\narising after the updated version takes effect. A previously confirmed project remains governed<br \/>\nby the terms agreed for that project unless the parties agree otherwise or law requires a change.<\/p>\n<h2 id=\"complaints\">20. Complaints and Service Concerns<\/h2>\n<p>If you have a complaint or service concern, please provide enough information for BKMOS to identify<br \/>\nand review the matter, such as:<\/p>\n<ul>\n<li>your name and contact details;<\/li>\n<li>order or transaction reference;<\/li>\n<li>a description of the issue;<\/li>\n<li>relevant files, images or supporting evidence; and<\/li>\n<li>the outcome you are requesting.<\/li>\n<\/ul>\n<p>BKMOS will review the request based on the project record, the parties&#8217; communications,<br \/>\nsupporting evidence and applicable law.<\/p>\n<h2 id=\"law\">21. Governing Law and Dispute Resolution<\/h2>\n<p>These Terms and BKMOS service transactions are governed by the laws of Vietnam,<br \/>\nexcept where mandatory law provides otherwise.<\/p>\n<p>The parties should first attempt to resolve a dispute through direct discussion or other cooperative means.<br \/>\nIf a dispute cannot be resolved, either party may use a competent state authority,<br \/>\ndispute-resolution body or court in accordance with applicable law.<\/p>\n<p>These Terms do not restrict any complaint, consumer-protection, legal-action or other right<br \/>\nthat cannot lawfully be waived.<\/p>\n<h2 id=\"severability\">22. Severability<\/h2>\n<p>If any part of these Terms is held invalid, unlawful or unenforceable,<br \/>\nthe remaining provisions will continue to apply to the extent permitted by law.<br \/>\nThe invalid provision may be interpreted or replaced by a lawful provision that most closely reflects<br \/>\nits legitimate purpose while preserving the parties&#8217;
